By accessing and using PumpYou ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Service. We reserve the right to modify these terms at any time. Your continued use of the Service constitutes acceptance of any changes.

2. Service Description

PumpYou is a cryptocurrency token discovery and trading platform that provides:

• Token discovery and browsing interface
• Integration with Jupiter Aggregator for token swaps
• Token launchpad for creating custom tokens with bonding curves
• Watchlist and tracking features
• Subscription-based premium features
• Referral rewards program
• Token sponsorship opportunities

3. Eligibility

To use PumpYou, you must:

• Be at least 18 years of age
• Have legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Have a compatible Solana wallet
• Comply with all local laws and regulations regarding cryptocurrency

4. Wallet Connection and Security

You are responsible for:

• Maintaining the security of your wallet and private keys
• All transactions executed from your connected wallet
• Verifying transaction details before confirming
• Understanding that blockchain transactions are irreversible

PumpYou never has access to your private keys or seed phrases. We cannot recover lost funds or reverse transactions.

5. Financial Disclaimer

Cryptocurrency trading involves substantial risk:

• You may lose some or all of your invested capital
• Token values can be highly volatile and unpredictable
• Past performance does not guarantee future results
• Scams, rug pulls, and fraudulent tokens exist
• Regulatory changes may impact token values

Always conduct your own research (DYOR) and consult with qualified financial advisors before making investment decisions.

6. Subscriptions and Payments

Premium subscriptions are available for purchase:

• All payments are made in SOL on the Solana blockchain
• Subscriptions are non-refundable once activated
• Subscription benefits are active from activation date to expiry date
• We reserve the right to modify subscription pricing and features
• Expired subscriptions do not auto-renew

7. Referral Program

Our referral program allows users to earn commissions:

• Earn 50% commission on referred users' first subscription purchase only
• Earnings must be claimed through the platform
• Claims are processed manually and may take 24-48 hours
• We reserve the right to deny fraudulent or abusive referral activity
• Referral terms may change with notice

8. Token Sponsorship

Token projects may sponsor their tokens for featured placement. Sponsorship:

• Does not constitute an endorsement or recommendation
• Requires payment in SOL
• Is displayed with clear "SPONSORED" labels
• Does not guarantee performance or legitimacy
• May be subject to validation and approval

9. Token Launchpad

9.1 Free Tier & Subscription Tiers

• Free Tier: Available to all users with fixed parameters (50 SOL initial, 600 SOL migration, 1% trading fees with 0.5% to creator)
• Premium Tier: Active subscription required to customize bonding curves and creator fees
• No platform fees for token creation - only network transaction fees (~0.034 SOL)
• Free tier users cannot modify default parameters
• Subscription enables full customization of launch parameters

9.2 Token Configuration

• Network fees estimated at ~0.034 SOL for transaction costs
• Optional developer initial buy using your own funds

9.3 Creator Responsibilities

As a token creator, you are responsible for:

• Providing accurate token metadata (name, symbol, description, image)
• Ensuring token names and symbols are not misleading or infringing
• Complying with all applicable laws and regulations
• Understanding that created tokens are immutable on the blockchain
• Managing your token's community and communications
• Not creating scam tokens or "rug pull" schemes

9.4 Bonding Curve Mechanics

• Tokens use automatic bonding curve pricing
• Price increases as more tokens are purchased
• Liquidity is locked in the bonding curve contract
• Automatic migration to Raydium DEX when migration cap is reached
• Migration is irreversible once triggered

9.5 Launchpad Disclaimers

9.6 Token Review and Removal

• PumpYou reserves the right to remove or delist tokens from discovery features
• Tokens promoting illegal activity, scams, or hate speech will be removed
• Removal from platform does not affect on-chain token existence
• We may adjust or remove tokens without prior notice

10. Prohibited Activities

You may not:

• Use the Service for illegal activities
• Attempt to manipulate or exploit the platform
• Create fake accounts or referrals
• Scrape, spider, or harvest data from the Service
• Interfere with the Service's operation or security
• Impersonate others or misrepresent your identity
• Promote scams or fraudulent tokens knowingly
• Create tokens that impersonate existing projects
• Launch tokens with malicious intent or "rug pull" schemes

11. Intellectual Property

PumpYou and its content, features, and functionality are owned by PumpYou and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without express permission.

12. Third-Party Services

PumpYou integrates with third-party services including:

• Jupiter Aggregator: For token swaps and trading functionality
• Jupiter API: For token creation and launchpad infrastructure
• Solana Blockchain: For all on-chain transactions and token storage

PumpYou acts solely as an intermediary platform. We are not responsible for the availability, accuracy, functionality, or any issues arising from these third-party services. Token launches are executed via Jupiter API infrastructure - PumpYou does not control the token creation process, smart contracts, or bonding curve mechanics. Use of third-party services is subject to their own terms and conditions.

You agree to indemnify and hold PumpYou harmless from any claims, losses, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party. This includes claims related to tokens you create via the launchpad.

15. Termination

We reserve the right to suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time by disconnecting your wallet.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable international laws. Any disputes shall be resolved through arbitration or appropriate legal channels.

17. Changes to Terms

We may modify these Terms at any time. Material changes will be notified through the platform. Your continued use after changes constitutes acceptance of the updated Terms.
